Trade Finance Fraud Investigations

Trade finance fraud is one of the most technically complex categories of financial crime, exploiting the documentary nature of trade finance instruments, the cross-border complexity of international trade transactions, and the information asymmetry between banks that finance trade and the underlying commercial reality that those transactions are supposed to represent. It is estimated to cost the global financial system tens of billions of dollars annually, and UK financial institutions with significant trade finance books face material exposure.

Common Trade Finance Fraud Schemes

Phantom shipments: trade finance drawn against goods that do not exist, supported by falsified shipping documents, bills of lading, inspection certificates, and warehouse receipts.

Double financing: the same underlying trade transaction and the same documents used to raise financing from multiple banks simultaneously.

Over-invoicing: the presentation of inflated invoices to secure financing in excess of the actual value of the underlying goods.

Commodity fraud: goods that exist but whose quality, quantity, or value is misrepresented — a common pattern in commodity trade finance involving oil, metals, and agricultural products.

Connected party transactions: circular trade structures in which the buyer and seller are connected parties, creating the appearance of a commercial transaction for the purpose of accessing financing with no underlying genuine trade.

The Investigation Approach

Trade finance fraud investigations require the ability to verify the underlying commercial reality of a transaction: whether the goods exist, whether the documents accurately represent the transaction, and whether the parties to the transaction are genuinely independent. This requires both financial forensic analysis of the documentary evidence and, in many cases, on-the-ground investigation in the jurisdictions where the goods are supposed to be located.
