Process Server FAQs

What happens if you cannot complete process serving?

In cases of avoidant or difficult defendants Bond Rees will persist and can employ person or debtor tracing services in cases of extreme evasion or absconding.

If process serving of the defendant or recipient proves entirely impossible, there are other options available such as substituted service and this will not cause proceedings to stop.

What information does a process server need?

Any information you can provide will be helpful and potentially enable faster process serving to be completed; as well as the basic information of full name and address it can be beneficial to have the date of birth, any other known locations they attend, a current photograph, and any details of known risks such as violence or drug use.

Don’t worry if you only have minimal information, however, as our professional process servers are able to make a start on your service with minimum details.

What if the defendant attempts to evade service?

If it is detected that the defendant is present at the premises, we attend but hiding from service, our process servers will employ legitimate and responsible techniques to encourage contact and will persist with service attempts in a respectful but resolved approach.

If the defendant appears to have absconded or relocated, we can also provide services to resolve this issue such as person or debtor tracing if requested.

Can you process serve someone by email?

Process service needs to be conducted in person with adequate proof of receipt obtained to prevent later denial of this by the defendant so cannot be carried out via email.
