Once we have possession of relevant documents and information needed Bond Rees process servers will proceed with initial service attempt at the primary or home address and will undertake 3 visits to this location to conduct process serving.
If the primary or home address does not facilitate service, we will try other locations that hold potential for service such as a workplace or home of a partner or family member or other stated locations.
If we detect that the defendant or recipient is at the address but not cooperating with service, we will make use of legally compliant techniques to promote contact and enable service, and if a defendant has temporarily moved or permanently relocated, we can also provide person or debtor tracing services if required.
In the rare situation that we cannot complete service, Bond Rees will furnish our client with all required documentation and information to allow application for third-party or substituted service and help with reducing any delay to proceedings however we can.
Once service is concluded, we will alert our client and issue all confirmation required such as a statement of service or sworn affidavit as appropriate.
Can a defendant try to trick a process server?
It is not uncommon for defendants to try to evade or trick process servers and Bond Rees are highly experienced in detecting this and have many strategies to counter such behaviour. There are many options to complete process serving and trying to trick a server will not stop proceedings of benefit the defendant in any way.
What is it illegal for a process server to do?
Process servers cannot force entry to private property, impersonate an official such as a police officer or court official, or use threat, intimidation, or aggression to achieve service.
What information does a process server need?
It is beneficial to process serving if you can provide as much information about the defendant or recipient as possible; full name, home address, work address, any other known frequented locations, and a current photograph can all be extremely useful.
It’s also pertinent to advise of any known risks such as a history of violence or any suspected substance misuse so that our process servers can prepare, and risk assess this appropriately.
However, do not be overly worried if you do not have all of this information as we can still undertake process serving with limited or basic details where necessary.
Can process serving be done via email?
Certain legal documents need to be delivered in person with proof of identity being obtained from the defendant or recipient, and evidence provided that service has been undertaken so cannot be completed via email.
