Bond Rees will make three attempts to process serve at the home or primary location and make use of legitimate and resourceful approaches and techniques conducive to gaining contact and facilitating process serving if the defendant or recipient behaves in an evasive or non-compliant manner.

Following any lack of success at the home address, our process servers will attempt to serve at other premises that offer potential for this such as a workplace or other address or premises that the defendant is reported to attend regularly.

Having achieved contact with the defendant or recipient we will undertake process serving with full regard for civil procedure and ensuring verification of identity and evidence of service.

Once process serving has been achieved, we will alert our client and send on confirmation of this such as a statement of service or sworn affidavit as applicable.

Can summons be served by email?

Specific legal documents, including summons, need to be delivered to the concerned party in person and verification of their identity and adequate evidence of service obtained so cannot be served via email.

Can someone hide from a process server?

The defendant is not obliged to present themselves for serving and it is not uncommon for individuals to attempt to evade or avoid serving by various means including hiding.

However, other options beyond standard process serving are available, and this behaviour will not cease proceedings and is of little long-term benefit to the defendant in reality.

What can a process server not do?

A process server is not allowed force entry or break into private property, use threats, intimidation or abusive language or behaviours to achieve serving, impersonate a protected professional such as police officer or court official, or serve documents to an unspecified or unnamed individual.
