If the defendant is present and co-operative, our agent will obtain and record proof of identity and serve the papers in person, by hand. If unsuccessful, the process server will make 3 further visits to the primary or home address before attempting other locations such as a place of work.

We are tenacious, persistent, and committed in cases of avoidant or evasive defendants and will employ legitimate tactics aimed at gaining contact with the recipient if we deem them to be at the property, and we can also offer person or debtor tracing in the case of extremely evasive defendants.

Process servers must not force entry to private property, impersonate another profession such as a police officer or court official, and must not use force, threat, or intimidation to achieve serving.

Is it illegal to evade process serving?

There is no legal obligation placed on the defendant to make themselves available for process serving although their efforts to evade not prevent legal proceedings from continuing as there are many other options available and attempts to evade will be of little long term benefit to the defendant.

Do I need a professional process server?

Hiring a professional process server ensures this process is carried out with correct procedure, prevents risk to involved individuals of aggression or conflict, and ensures that service is adequately evidenced so there can be no denial or challenge of this by the other party or defendant.

What happens if you can’t serve someone?

We will try other options such as other known addresses or locations to serve the individual and, if this fails, we will support application for substituted service and provide any further help and assistance we can with this.
