Process servers cannot force entry to private property, use threat, force, intimidation, or aggression to achieve service, and cannot pose as another professional such as a police officer or court official.

Can a defendant refuse to be process served?

A defendant can refuse to accept documents by hand but cannot refuse service itself as the agent can place the documents in their physical proximity and within sight and demonstrate with evidence that this has occurred, and this constitutes service.

Will proceedings have to stop if you can’t serve someone?

There are many further options if a defendant or individual evades service such as third-party or substituted service and other means used to give notice; proceedings will not terminate if initial attempts to serve are unsuccessful.
