Process Server FAQs

What can a process server not legally do?

A process server is legally prevented from forcing entry to private property, using aggression or threats or abusive language or behaviours to achieve serving, impersonating a protected professional role such as police officer or court official, or serving documents to an alternative individual unless proper consent and instruction is given.

What happens if a process server cannot serve the document?

A professional process server will utilise many techniques and methods and be persistent and tenacious in their endeavour to process serve an individual.

However, if serving remains impossible there are other options such as third-party or substitute service where documents are agreed to be provided to another individual connected to the target or even for notice to be given through forms of media in extreme situations.

Can process serving be done via email?

Some legal documents need to be issued in person and identification of the recipient verified so cannot be served via email.

Can you sue someone if you cannot serve them?

The defendant has no obligation to make themselves available for serving and it is common for an individual to try to evade or hide from a process server. This may cause some delay but will not prevent serving in the long run or prevent the progress of proceedings so has little benefit for the defendant in the end.
